TERMS & CONDITIONS

I will always do my best to fulfill and even exceed your photography expectations. But it is best that everyone understands how things work, who does what and when, and what happens if something goes wrong.

Any photoshoot booked will work according to the terms and conditions.

PRICING:

• A full payment reserves the client a shoot, and the shoot will not commence before payment has been made in full.

• If the client (who has already paid) cancels a shoot within 24 hours of the shoot as a result of anything outside of an emergency beyond their control, a cancelation fee of 25% will be withheld, and the remaining 75% will be refunded.

• If the client (who has already paid) cancels a shoot within 24 hours of the shoot as a result of an emergency, they will be refunded the full amount paid.

​All prices shown within the Photographer’s price list are subject to change without prior notice.

TIMING:

Regarding time in a shoot, if you come 30 minutes late, you miss out 30 minutes of the shoot, and that money will not be refunded. Please arrive at least 30 minutes early to a shoot.

RIGHTS:

The photographer holds the right to retain, reproduce, post on social media and on this website all photos taken of the client, unless a contract is otherwise signed by both photographer and client. 

In accordance with South Africa’s Copyright Laws, the copyright of all images created by the Photographer is owned by the Photographer. Jayden Collier Photography retains all copyright benefit for all images created by himself forever.

The Photographer reserves the right to amend these Terms and Conditions without prior notice.

If one of the images created by our photographers is used for any commercial or financial gain purpose, at any time, without our permission in writing, you agree to pay us for the use of the image at the current market rate as determined by the use at the time.

Example: You send a magazine an image created by the Photographer, Jayden Collier, the magazine pays you for the image. You owe Jayden Collier Photography 100% of that payment + liquidated damages, on-demand.

PHOTO PURCHASING TERMS:

• Payment and Delivery

  • All photos must be paid for in full before delivery.

  • Upon receipt of payment, high-quality images will be transferred via a secure method (e.g., WeTransfer).

• Usage Rights

  • Purchased photos include only the rights specified in the agreement.

  • Unauthorized reproduction, resale, or modification of the image is strictly prohibited unless explicitly agreed upon in writing.

• Exclusivity and Licensing

  • Exclusive rights grant the buyer sole usage of the image, and neither party may license or sell it to others.

  • Non-exclusive rights allow the buyer to use the image, but the photographer retains the right to license or sell it to other parties.

  • For other licensing arrangements (e.g., editorial, commercial, or joint partnership), specific terms will be outlined in the agreement.

• Refunds and Cancellations

  • Due to the digital nature of the product, refunds are not provided once the image has been delivered.

  • Cancellations before delivery may be subject to a cancellation fee to cover any incurred costs.

• Customization and Revisions

  • Any requested edits or customizations must be agreed upon in writing and may incur additional charges.

• Limitations of Liability

  • The photographer is not responsible for any issues arising from improper use or alteration of the images by the buyer.

  • Images are delivered in high quality; any printing or usage quality concerns must be addressed with the respective service provider.

• Acknowledgment of Terms

  • By purchasing a photo, the buyer acknowledges and agrees to these terms and conditions.
